Constitutional Court Judgement 237/2005, Spain 2005, Rigoberta Menchú case (Guatemala)

 

The Spanish Constitutional Court decided that the principle of subsidiarity was not part of Spain’s positive law or of the Genocide Convention and that the lower courts were wrong to have limited Spain’s exercise of universal jurisdiction in the case, so the case of Rigoberta Menchú fell under the jurisdiction of the Spanish courts.
