THE GUERNICA GROUP DEMANDS AN IMMEDIATE INVESTIGATION OF THE RESPONSIBILITY OF THE ARMED FORCES IN VIOLENT ACTS OCCURRING DURING THE MANIFESTATIONS IN COLOMBIA
We denounce the disproportionate use of force against the Colombian citizenry, and we demand a rigorous, prompt, and effective investigation of the crimes committed by members of the Armed Forces. This process of investigation should clarify the violent acts that have occurred since the 28th of April, 2021, and analyze possible patterns of conduct behind these acts, identifying the role of those most responsible, including civilians, military, and police who exercised violent force.
In the context of the recent peaceful manifestations of diverse social sectors in response to the economic initiatives of the Executive Branch, the Colombian State has reacted with severe repression through police and military force. We call upon the State to fulfill their duty to take prompt and serious action to investigate and sanction the grave acts that have occurred in which at least 31 civilians have lost their lives, hundreds have been injured, and claims of arbitrary and illegal detentions, torture, sexual violence, and other crimes continue to circulate. We also call upon the international community to monitor the evolution of the situation in Colombia and the status of the investigations necessary to clarify responsibilities.
We recognize that the government of Colombia has a duty to respect and guarantee human rights derived from its international obligations. Article 21 of the International Covenant on Civil and Political Rights and Article 15 of the American Convention on Human Rights recognize the right to peaceful assembly. Additionally, the UN Code of Conduct for Law Enforcement Officials indicates that these persons can use force “only when strictly necessary” and in accordance with the principle of proportionality, under which the use of firearms is an “extreme measure.” In the same vein, the Human Rights Committee of the United Nations recognizes that security forces should use “only the minimum force necessary may be used where it is required” and that firearms “are not an appropriate tool for the policing of assemblies” and must never be used simply to disperse an assembly. The state is responsible for the actions and oversight of members of the security forces.
The processes of vindication of rights, social leadership, and peaceful protest are under threat in Colombia. In addition to the complicated situation that cities across Colombia are facing in recent days, regions that have been most affected by the conflict suffer from attacks against ethnic leaders and authorities. Since the signing of the Peace Accords between the Government of Colombia and the FARC-EP in 2019, the threats, repression, and assassinations against social leaders and ex-combatants of the FARC-EP have increased exponentially. Amidst this public security situation, illegal armed actors are reoccupying territories and the State fails to respond. The Guernica Group supports territorial communities and organizations who demand effective recognition of their rights and will continue to accompany them in processes of truth seeking, justice, reparations, and non-repetition – an urgent task for the dismantling of the root causes of violence in Colombia.
The Guernica Group calls for a return to democratic order, continued respect for human rights, fighting against impunity, and the creation of spaces for dialogue across social and political sectors as appropriate mechanisms to respond to the crisis that the country faces. Above all, respect for human life and personal integrity should take precedence in any situation.

EL GRUPO GUERNICA RECLAMA UNA INVESTIGACIÓN EFECTIVA DE LA RESPONSABILIDAD DE LA FUERZA PÚBLICA EN LOS HECHOS VIOLENTOS SUCEDIDOS DURANTE LA REPRESIÓN DE MANIFESTACIONES EN COLOMBIA
Desde Guernica rechazamos el uso desproporcionado de la fuerza en contra de la ciudadanía en Colombia y reclamamos una investigación rigurosa, oportuna y efectiva de los delitos cometidos por miembros de la Fuerza Pública. Este proceso de investigación debe esclarecer los hechos violentos sucedidos desde, al menos, el día 28 de abril de 2021, a fin de asignar distintas responsabilidades e identificar los posibles patrones de conducta tras los mismos, aclarando el rol que los máximos responsables civiles, militares y policiales puedan haber ejercido en la violencia.
En el marco de las manifestaciones pacíficas convocadas en los últimos días por diversos sectores sociales contra las iniciativas económicas del Ejecutivo, el Estado colombiano ha respondido con una severa represión policial y militar. Llamamos al Estado a cumplir su deber de investigar y sancionar seria y oportunamente los graves hechos ocurridos en pasados días en los que al menos 31 civiles han perdido la vida, cientos han resultado heridos, y hay denuncias de detenciones arbitrarias e ilegales, torturas y violencia sexual, entre otros delitos. Asimismo, llamamos a la comunidad internacional a hacer seguimiento de la evolución de la situación en Colombia y del estado de las investigaciones necesarias para aclarar responsabilidades.
Recordamos que el gobierno colombiano está obligado a cumplir con los deberes de respeto y garantía de los derechos humanos derivados de sus obligaciones internacionales. El artículo 21 del Pacto Internacional de Derechos Civiles y Políticos y el artículo 15 de la Convención Americana sobre Derechos Humanos reconocen el derecho de reunión pacífica. Recordamos que el Código de conducta de Naciones Unidas para funcionarios encargados de hacer cumplir la ley, indica que estos funcionarios podrán usar la fuerza “sólo cuando sea estrictamente necesario” y de acuerdo con el principio de proporcionalidad, por lo que el uso de armas de fuego es “una medida extrema”. En este mismo sentido, el Comité de Derechos Humanos de Naciones Unidas recuerda que las fuerzas de seguridad solo pueden utilizar “la fuerza mínima necesaria cuando sea imprescindible”, que las armas de fuego “no son un instrumento adecuado para vigilar las reuniones” y que no se deben utilizar nunca simplemente para dispersar una reunión. El Estado es responsable de las acciones y omisiones de los agentes pertenecientes a las fuerzas del orden.
Los procesos de reivindicación de derechos, el liderazgo social y la protesta pacífica están bajo amenaza en Colombia. A la situación que se vive por estos días en las principales ciudades en Colombia se suman los ataques contra los liderazgos y las autoridades étnicas en las regiones que históricamente han sido más afectadas por el conflicto. Desde la firma del Acuerdo de Paz entre el Gobierno y las FARC-EP en 2016, las amenazas, represión y asesinatos contra líderes sociales y ex combatientes de las FARC-EP se ha incrementado exponencialmente, en medio de una situación de orden público preocupante por la reacomodación de actores armados ilegales en los territorios y la falta de respuesta estatal efectiva. El Grupo Guernica apoya a las comunidades y organizaciones territoriales que reclaman un disfrute efectivo de sus derechos y continuará acompañando los procesos de búsqueda de verdad, justicia, reparación y no repetición – una tarea prioritaria para la desestructuración de las causas de la violencia que azota a Colombia.
El Grupo Guernica hace un llamado para que predominen el orden democrático, el respeto de los derechos humanos, la lucha contra la impunidad y el diálogo entre sectores sociales y políticos, como mecanismos idóneos para hacer frente a la crisis por la que atraviesa el país. Ante todo, el respeto por la vida y la integridad personal debe primar ante cualquier situación.
