Weekly Update from The Special Jurisdiction For Peace in Colombia

The Guernica Group

For The Guernica Group, the work developed by the Integral System of Truth, Justice, Reparation and No Repetition (SIVJRNR) of Colombia is essential to carry out and consolidate the Peace Accord. Victims are the central pillar and the guarantee for the need to define the truth and ensure accountability for key episodes of violence committed during the armed conflict, as the basis of long-lasting reconciliation. The Special Jurisdiction for Peace (JEP) has the potential to develop new legal precedents that could reshape the work of international criminal lawyers and generate a valuable legacy for the whole Latin American region.

Accordingly, The Guernica Group will provide weekly media updates from the Special Jurisdiction for Peace in order to expand the JEP’s outreach and generate debate around the cases, the judicial proceedings and the procedures of the different Chambers. The summary of the news will be published in both English and Spanish, and will include links to the relevant articles.

§ Victims of the armed conflict of Yarumal and Tumaco submit reports to the Special Jurisdiction for Peace:

8th August, victims of the armed conflict of Yarumal and Tumaco submitted two new reports to the Special Jurisdiction for Peace (JEP): “The White Paper of Yarumal. For the memory, the life and the dignity of the victims of the armed conflict”, carried out by the Committee of Participation of Victims of Yarumal (Antioquia); and “Tumaco: Tired of the war, longing for peace”, submitted by the legal corporation Yira Castro (CJYC).

The report of Yarumal reflects, through a timeline made between 1987 and 2017, how this municipality was affected during the war by the FARC (fronts 36 and 18), the ELN, the peasants Autodefensas of the North, the CONVIVIR, the paramilitaries (1997-2007) and other armed groups. On the other hand, the report of Tumaco reflects specifically, the impact of the war on the peasants of the community of Alto Mira and Fronteria, as well as specific cases in Ricaurte, La Llanada, El Vergel and Santa Cruz of Guachavez, in the area of Santa Maria. To date, the Room of Recognition of the JEP has received 214 reports.

§ The Special Jurisdiction for Peace publishes a book titled; “Framework of the Special Jurisdiction for Peace”:

Raúl Eduardo Sánchez, Magistrate of the Special Jurisdiction for Peace, and his team have written and published a book called “Framework of the Special Jurisdiction for Peace”, that gathers and discusses the rules of the JEP, in order to promote clarity regarding its legal framework.

§ The Special Jurisdiction for Peace and the Attorney General of the Nation hold talks with the victims in Guajira about restorative justice:

Last Friday 9 August, the Special Jurisdiction for Peace (JEP) and the Attorney General of the Nation (PGN) organized in Riohacha, La Guajira, the forum “Voices of the victims: intercultural dialogue and restorative justice” with the objective of speaking with victims of the armed conflict about restorative justice. This forum encouraged intercultural dialogue between indigenous leaders of communities, international panellists, magistrates of the JEP and civil servants of the Attorney General, providing the opportunity to exchange teachings of indigenous justice in transitional justice.

This is the second event to have been organised by the bodies. Patricia Linares Prieto, President of the JEP and Fernando Carrillo Flórez, Attorney General of the Nation both participated.

§ The Special Jurisdiction for Peace (JEP) holds an audience in Apartadó, Antioquia, to listen to the farmers:

During the first week of August, the Special Jurisdiction for Peace (JEP) held an audience in Apartadó, Antioquia, to listen to the stories of the farmers that are today reclaiming their land that was taken away by armed groups and business owners during the armed conflict. This task is something that the habitants of Urabá wanted to add to the written report; “They go through our lands: blood and fire”, produced by the Intereclesial Commission of Justice and Peace (CUP), the Liberty Legal Corporation (CJL), the Forging Futures Foundation (FFF) and the Popular Training Institute (IPC) presented to the JEP last year.

§ The State Council rejects the suggestion that the loss of investiture process against former congressman Musa Besaile Fayad can be referred to the Special Jurisdiction for Peace:

The State Council has rejected the appeal brought by the former congressman Musa Besaile Fayad, with which he intended to knock down the decision of first instance that refused to refer his loss of endowment process to the Special Jurisdiction for Peace (JEP). The State Council declared that the JEP is not a competent organ to advance, in the second instance, the processes of loss of investiture against delegates, the State Council being the only body with competence in the matter.

§ Marilú Ramírez, known as “la Mata Hari” of the FARC-EP, requests a pardon from the Special Jurisdiction for Peace:

Marilú Ramírez, known as “la Mata Hari” of the FARC-EP for having infiltrated the military forces, has requested a pardon from the Special Jurisdiction for Peace for the bomb attack on the war high school in the north of Bogotá in the year 2006. The Magistrates are currently evaluating the request.

§ The Special Jurisdiction for Peace will service the 194 municipalities of the Caribbean Coast with the opening of an office in Corozal, Sucre:

Monday 5 August, the Special Jurisdiction for Peace (JEP) formally opened its first office outside of Bogotá, in Corozal (Sucre) with the hope that it will attend to the 194 municipalities of the Caribbean Coast and guarantee the territorial presence to victims and their peers, as well as supporting the investigation and prosecution. With this new office in Corozal, the JEP aims to reinforce its territorial deployment and reiterate its commitment to justice and the whole truth in the regions that historically have been affected by the armed conflict, being closer to the victims with psychosocial support and legal attention. Similarly, it aims to provide advice to peers through the Autonomous Advisory and Defense System (SAAD), and facilitate the practice of diligency, investigation and inspection of processes.

§ Manuel Joaquín Palacios Asprilla, former Mayor of Bojayá, is sentenced to prison for parapolitics:

Last Monday 5 August, Manuel Joaquín Palacios Asprilla, former Mayor of Bojayá, was sentenced to 7 years and 6 months of prison for sponsoring a paramiltary block that committed crimes in the region between the years 1997 and 1999. The former civil servant was sentenced for the crime of making an agreement to aggravate crime. The Judge made his decision with the information that a member of the paramilitary Fredy Rendón Herrera, alias ‘The German, submitted to the JEP, in which he declared that the former mayor had given high sums of money for the paramiltaries to fight guerrilla groups and provided security to their movements.

§ Víctimas del conflicto armado de Yarumal y Tumaco entregan informes a la Jurisdicción Especial para la Paz:

El pasado 8 de agosto, víctimas del conflicto armado de Yarumal y Tumaco entregaron a la Jurisdicción Especial para la Paz (JEP) dos nuevos informes: "El libro blanco de Yarumal. Por la memoria, la vida y la dignidad de las víctimas del conflicto armado", realizado por la Mesa de Participación de Víctimas de Yarumal (Antioquia); y "Tumaco: cansados de la guerra, anhelantes de la paz", entregado por la Corporación Jurídica Yira Castro (CJYC).

El informe de Yarumal refleja, a través de una línea de tiempo realizada entre los años 1987 y 2017, cómo este municipio fue afectado durante la guerra por las FARC (los frentes 36 y 18), el ELN, las Autodefensas Campesinas del Norte, las Convivir, los paramilitares (1997-2007) y otros grupos armados. Por otro lado, el informe de Tumaco refleja, específicamente, el impacto de la guerra sobre los campesinos de la comunidad de Alto Mira y Frontera, así como casos puntuales en Ricaurte, La Llanada, vereda El Vergel, y Santa Cruz de Guachavez, en el sector de Santa María. A la fecha, la Sala de Reconocimiento de la JEP ha recibido 214 informes.

§ La Jurisdicción Especial para la Paz publica un libro titulado “Marco normativo de la Jurisdicción Especial para la Paz”:

Raúl Eduardo Sánchez, magistrado de la Jurisdicción Especial para la Paz, y su equipo de trabajo han escrito y publicado un libro denominado “Marco normativo de la Jurisdicción Especial para la Paz”, que reúne las reglas de la JEP comentadas, en aras de promover claridad respecto a su marco jurídico.

§ La Jurisdicción Especial para la Paz y la Procuraduría General de la Nación dialogan con víctimas en la Guajira sobre justicia restaurativa:

El pasado viernes 9 de agosto, la Jurisdicción Especial para la Paz (JEP) y la Procuraduría General de la Nación (PGN) organizaron en Riohacha, La Guajira, el foro “Voces de las víctimas: diálogo intercultural y justicia restaurativa", con el objetivo de dialogar con víctimas del conflicto armado sobre la justicia restaurativa. Este foro fomenta el diálogo intercultural entre líderes de comunidades indígenas, panelistas internacionales, magistrados de la JEP y funcionarios de la Procuraduría, otorgando la oportunidad para intercambiar enseñanzas de la justicia indígena en la justicia transicional.

Este evento es el segundo organizado por las dos entidades. Contó con la participación de Patricia Linares Prieto, presidenta de la JEP, y Fernando Carrillo Flórez, Procurador General de la Nación.

§ La Jurisdicción Especial para la Paz (JEP) realiza una audiencia en Apartadó, Antioquia, para escuchar a los campesinos:

La primera semana de agosto, la Jurisdicción Especial para la Paz (JEP) realizó una audiencia a Apartadó, Antioquia, para escuchar los relatos de los campesinos que hoy están reclamando su tierra arrebatada por grupos armados y empresarios durante el conflicto armado. Esta diligencia es un complemento que los habitantes de Urabá quisieron agregar al informe escrito “Van por nuestras tierras: a sangre y fuego”, elaborado por la Comisión Intereclesial de Justicia y Paz (CUP), la Corporación Jurídica Libertad (CJL), la Fundación Forjando Futuros (FFF) y el Instituto Popular de Capacitación (IPC) y presentado ante la JEP el año pasado.

§ El Consejo de Estado rechaza que proceso de pérdida de investidura contra el excongresista Musa Besaile Fayad pueda ser remitido a la Jurisdicción Especial para la Paz:

El Consejo de Estado ha negado el recurso interpuesto por el excongresista Musa Besaile Fayad, con el que pretendía tumbar la decisión de primera instancia que negó remitir su proceso de pérdida de investidura a la Justicia Especial para la Paz (JEP). El Consejo de Estado manifestó que la JEP no es el órgano competente para adelantar, en segunda instancia, los procesos de pérdida investidura contra congresistas, siendo el Consejo de Estado el único órgano con competencia en la materia.

§ Marilú Ramírez, conocida como “la Mata Hari” de las FARC-EP, solicita un indulto a la Jurisdicción Especial para la Paz:

Marilú Ramírez, conocida como “la Mata Hari” de las FARC-EP por haber infiltrado las fuerzas militares, ha solicitado un indulto a la Jurisdicción Especial para la Paz por el atentado con un carro bomba a la escuela superior de guerra en el norte de Bogotá en el año 2006. Los magistrados están actualmente evaluando la solicitud.

§ La Jurisdicción Especial para la Paz atenderá a 194 municipios de la Costa Caribe con la apertura de su oficina en Corozal, Sucre:

El lunes 5 de agosto, la Jurisdicción Especial para la Paz (JEP) inauguró su primera oficina fuera de Bogotá, en Corozal (Sucre), con la que se espera atender a 194 municipios de la Costa Caribe y garantizar la presencia territorial a víctimas y comparecientes, así como el apoyo en investigación y acusación judicial. Con esta nueva oficina en Corozal, la JEP pretende reforzar su despliegue territorial y reiterar su compromiso con la justicia y la verdad plena en las regiones que históricamente se han visto afectadas por el conflicto armado, estando más cerca de las víctimas con acompañamiento psicosocial y atención jurídica. De igual forma, se pretende garantizar la asesoría a comparecientes a través del Sistema Autónomo de Asesoría y Defensa (SAAD), y facilitar la práctica de diligencias e investigación e inspección de procesos.

§ Manuel Joaquín Palacios Asprilla, exalcalde del Bojayá, es condenado a prisión por parapolítica:

El pasado lunes 5 de agosto, Manuel Joaquín Palacios Asprilla, exalcalde del Bojayá, ha sido condenado a siete años y seis meses de prisión por patrocinar a un bloque paramilitar que delinquía en la región entre los años 1997 y 1999. El exfuncionario fue sentenciado por el delito de concierto para delinquir agravado. El juicio se resolvió con la información que el paramilitar Fredy Rendón Herrera, alias ‘El Alemán’, entregó a la Jurisdicción Especial para la Paz, al haber declarado que el alcalde había entregado altas sumas de dinero para que los paramilitares combatieran a los grupos guerrilleros y prestaran seguridad en sus desplazamientos.
