For The Guernica Group, the work developed by the Integral System of Truth, Justice, Reparation and No Repetition (SIVJRNR) of Colombia is essential to carry out and consolidate the Peace Accord. Victims are the central pillar and the guarantee for the need to define the truth and ensure accountability for key episodes of violence committed during the armed conflict, as the basis of long-lasting reconciliation. The Special Jurisdiction for Peace (JEP) has the potential to develop new legal precedents that could reshape the work of international criminal lawyers and generate a valuable legacy for the whole Latin American region.

Accordingly, The Guernica Group will provide weekly media updates from the Special Jurisdiction for Peace in order to expand the JEP’s outreach and generate debate around the cases, the judicial proceedings and the procedures of the different Chambers. The summary of the news will be published in both English and Spanish, and will include links to the relevant articles.

· The Special Jurisdiction for Peace rejects the re-armament of some former commanders of the FARC-EP:

Thursday 29 August, some former commanders of the FARC-EP issued a statement announcing their rearmament and the return to a “new stage in the armed fight”.

The President of the JEP, Patricia Linares, has characterized the re-armament of the guerrilla ex-commanders as “a fact of the greatest gravity for the peace process that, with sacrifices and not without difficulty, is being developed in Colombia”, declaring that the law establishes, as a consequence, the loss of all criminal benefits, including the expulsion from the Integral System of Truth, Justice, Reparation and No Repetition. In effect, before the return to arms to some former members of the extinct FARC-EP- among which are Luciano Marín Arango, known as “Iván Márquez”; Seuxis Pausias Hernández Solarte, alias “Jesús Santrich”; Henry Castellanos Garzón, alias "Romaña"; José Vicente Lesmes, alias "Walter Mendoza"; y José Manuel Sierra Sabogal, alias "Zarco Aldinever"- the Chamber of Recognition of Truth, Responsibility and Determination of Facts and Conduct of the JEP has ordered the revocation of the benefit of the suspension of the orders of capture and their conditional liberty, ordering the National Police to effect their capture.

It is worth noting that the Chamber of Recognition had already ordered the opening of a compliance verification incident against the aforementioned former guerrilla members for not fulfilling their commitments before the Comprehensive System of Truth, Justice, Reparation and Non-Repetition. In this sense, the Chamber has reiterated that this process will be accelerated, advancing in turn the identification of other appearing parties who, having criminal benefits before the System, have taken back their weapons.

· Camilo Gómez, Commissioner of the Government of Andrés Pastrana, appears before the JEP:

Camilo Gómez has appeared before the JEP in the framework of case 001 called “Illegal retention of persons by the FARC-EP”, in relation to what happened during his tenure as Commissioner of the Government of Andrés Pastrana, at the time when the Caguán peace process was developed. In this regard, Gómez has supposedly declared about the release of some 60 police and military members.

· The Special Jurisdiction for Peace opens a second territorial office in Cúcuta:

Last Wednesday 27 August, the JEP opened in Cúcuta its second office outside of Bogotá, in the premises 24 and 26 of the Agrobancario building (Street 10 5-50). With this new territorial office, the JEP hopes to attend the victims of 47 municipalities of the North of Santander and Arauca, reiterating their commitment to justice and for the full truth in the regions that historically have been affected by the armed conflict, where it will be closer to the victims with psychosocial support and legal assistance.

26 August, the Special Jurisdiction for Peace, the UN Mission of Verification in Colombia and the Ombudsman organised a public hearing at the centre of Filipinas, Arauca, about the implementation of the Peace Agreement in order to promote the agreement’s content between victims and the Colombian population.

· The accreditation of victims in the framework of case 001, called “Illegal retention of Persons by Farc-EP”, continues:

The Special Jurisdiction for Peace advances in the process of accreditation of victims within case 001, called “illegal retention of persons by FARC-EP”, known as “the kidnapping case”. In the last days, it has organised accreditation days in Girón (North of Santander), Chámeza (Casanare), María La Baja (Bolívar). El Doncello (Caquetá), Piedecuesta (Santander), Granada (Meta), Tunja (Boyacá), San José del Guaviare (Guaviare), Buenaventura (Valle del Cauca), Floridablanca (Santander), Garzón (Huila), Barranquilla (Atlántico), Bucaramanga (Santander), Argelia y Dabeiba (Antioquia), Arauca (Arauca), San Vicente del Caguán (Caquetá), Ocaña (North of Santander), Sonsón (Antioquia), Tunja (Boyacá) and Ipiales (Nariño).

· The former minister and lawyer Álvaro Leyva confirms that the former- paramilitary Carlos Mario Jiménez, alias “Macaco”, desires to be heard before the Special Jurisdiction for Peace:

The former minister and lawyer Álvaro Leyva has assured, through his Twitter account, that the former paramilitary Carlos Mario Jiménez, alias “Macaco”, who he has met, has expressed his desire to be heard before the Special Jurisdiction for Peace and the Commission of Truth, in order to tell the whole truth about the armed conflict. .

It should be remembered that alias “Macaco” was the commander of “Central Bolivian Block” of the Autodefensas Unidas de Colombia (AUC), a group responsible for multiple extrajudicial killings, torture and enforced disappearances in Colombia during the years 1999 and 2005. Alias “Macaco” is currently detained at “La Picota” prison in Bogotá, after being deported by the authorities of the United States of America upon serving a sentence for drug trafficking offences.

· The 61 Administrative Court of Bogotá orders the Ministry of Defence and the National Army of Colombia to organise an act of public forgiveness for the case a double “false positives” in Casanare:

The 61 Administrative Court of Bogotá has ordered the Ministry of Defence and the National Army of Colombia to organise an act of public forgiveness to the families of Daniel Torres Arciniegas and Roque Julio Torres Torres, two day labourers that who were presented as armed guerrillas in combat by the XVI Brigade in 2015.

The decision of the Court took into consideration the testimony of the retired lieutenant Fabián García Cespedes, who formed part of the XVI Brigade and ordered to retain and kill the two labourers before dressing them in camouflage guerrilla clothing, a practice known as “false positives”. García Cespedes, sentenced to 26 years in prison, after accepting his responsibility in the double homicide, declared on the details of this crime pointing directly to commander of the Brigade in the period of the facts, General Henry Torres Escalante. The investigation against General Escalante is currently in the JEP, a jurisdiction to which it was submitted after the Attorney General’s Office file dan accusation against him.

· Former solider José Perenguez Ortiz, sentenced for the extrajudicial jurisdiction of two young civilians in Suaza (Huila), requests to submit his case before the Special Jurisdiction of Peace

Former solider José Perenguez Ortiz, sentenced for the extrajudicial execution of two young civilians in Suaza (Huila), Juan Perdomo Claros and Alberty Augusto Lizcano Cedeño, who were later presented as guerrillas- a practice known in Colombia as “false positives”- requests his case to be submitted to the Special Jurisdiction for Peace. Specifically, Ortiz will appear as an agent of the State in order to assist in clarifying this extrajudicial execution practice.

ACTUALIZACIÓN SEMANAL - JURISDICCIÓN ESPECIAL PARA LA PAZ

§ La Jurisdicción Especial para la Paz rechaza el rearme de algunos excomandantes de las FARC-EP:

El jueves 29 de agosto, algunos excomandantes de las FARC-EP emitieron un comunicado anunciando su rearme y el regreso a “una nueva etapa en la lucha armada”.

La presidenta de la Jurisdicción Especial para la Paz, Patricia Linares, ha caracterizado el rearme de los excomandantes guerrilleros como “un hecho de la mayor gravedad para el proceso de paz que con sacrificio y no exento de dificultades se viene desarrollando en Colombia”, manifestando que la ley establece, como consecuencia, la pérdida de todos los beneficios penales, incluida la expulsión en el Sistema Integral de Verdad, Justicia, Reparación y No Repetición. En efecto, ante la vuelta a las armas de algunos exmiembros de las extintas FARC-EP - entre los que se encuentran Luciano Marín Arango, conocido como “Iván Márquez”; Seuxis Pausias Hernández Solarte, alias “Jesús Santrich”; Henry Castellanos Garzón, alias "Romaña"; José Vicente Lesmes, alias "Walter Mendoza"; y José Manuel Sierra Sabogal, alias "Zarco Aldinever" - la Sala de Reconocimiento de Verdad, de Responsabilidad y de Determinación de los Hechos y Conductas de la JEP ha ordenado revocar el beneficio de la suspensión de las órdenes de captura y de las libertades condicionales de los mismos, ordenando a la Policía Nacional su captura.

Cabe resaltar que la Sala de Reconocimiento ya había ordenado la apertura de incidente de verificación de cumplimiento contra los referidos exintegrantes de la antigua guerrilla por no cumplir con sus compromisos ante el Sistema Integral de Verdad, Justicia, Reparación y No Repetición. En este sentido, la Sala ha reiterado que este proceso del incidente se acelerará, avanzando a su vez en la identificación de otros comparecientes que, disponiendo de beneficios penales ante el Sistema, hayan retomado las armas.

§ Camilo Gómez, Comisionado del Gobierno de Andrés Pastrana, comparece ante la Jurisdicción Especial para la Paz:

Camilo Gómez ha comparecido ante la Jurisdicción Especial para la Paz en el marco del caso 001 denominado "Retención ilegal de personas por parte de las FARC-EP", en relación con lo sucedido durante su gestión como Comisionado del Gobierno de Andrés Pastrana, época en la que se desarrolló el proceso de paz del Caguán. En concreto, Gómez ha otorgado detalles sobre la liberación de unos 60 policías y militares.

§ La Jurisdicción Especial para la Paz abre en Cúcuta su segunda sede territorial:

El pasado martes 27 de agosto, la Jurisdicción Especial para la Paz (JEP) inauguró en Cúcuta su segunda sede fuera de Bogotá, en los locales 24 y 26 del edificio Agrobancario (Calle 10 # 5 -50). Con esta nueva sede territorial, la JEP espera atender a víctimas de 47 municipios del Norte de Santander y Arauca, reiterando su compromiso con la justicia y por la verdad plena en las regiones que históricamente se han visto afectadas por el conflicto armado, donde estará más cerca de las víctimas con acompañamiento psicosocial y atención jurídica.

§ La Jurisdicción Especial para la Paz organiza una audiencia pública sobre la implementación del Acuerdo de Paz:

El pasado 26 de agosto, la Jurisdicción Especial para la Paz, Misión de Verificación de la ONU en Colombia y la Defensoría del Pueblo organizaron una audiencia pública centro poblado de Filipinas, Arauca, sobre la implementación del Acuerdo de Paz, en aras de promover su conocimiento entre las víctimas y la población colombiana.

La Jurisdicción Especial para la Paz (JEP) avanza en el proceso de acreditación de víctimas dentro del caso 001, denominado "Retención ilegal de personas por parte de las Farc-EP", conocido como “el de secuestro”. En los últimos días, se han organizado jornadas de acreditación en Girón (Norte de Santander), Chámeza (Casanare), María La Baja (Bolívar). § El exministro abogado Álvaro Leyva confirma que el exparamilitar Carlos Mario Jiménez, alias “Macaco”, desea acudir a la Jurisdicción Especial para la Paz:

El exministro y abogado Álvaro Leyva ha asegurado, a través de su cuenta en Twitter, haberse reunido el exparamilitar Carlos Mario Jiménez, alias “Macaco”, quién le ha manifestado su deseo de acogerse a la Jurisdicción Especial para la Paz y la Comisión de la Verdad, a fin de contar toda la verdad sobre el conflicto armado.

Cabe recordar que alias “Macaco” era el jefe del “Bloque Central Bolívar” de las Autodefensas Unidas de Colombia (AUC), un grupo responsable de múltiples ejecuciones, torturas y desapariciones forzadas en Colombia durante los años 1999 y 2005. Alias “Macaco” se encentra actualmente privado de su libertad en la cárcel “La Picota”, de Bogotá, tras haber sido deportado por las autoridades de los Estados Unidos de América al cumplir una sentencia por delitos de narcotráfico.

§ El Juzgado 61 Administrativo de Bogotá ordena al Ministerio de Defensa y al Ejército Nacional de Colombia organizar un acto de perdón público por un caso de doble "falso positivo" en Casanare:

El Juzgado 61 Administrativo de Bogotá ha ordenado al Ministerio de Defensa y al Ejército Nacional de Colombia organizar un acto de perdón público a los familiares de Daniel Torres Arciniegas y Roque Julio Torres Torres, dos jornaleros que fueron presentados como guerrilleros abatidos en combate por la Brigada XVI en Casanare en el año 2015.

La decisión del juzgado tuvo en consideración el testimonio del teniente retirado Fabián García Cespedes, quien formaba parte de la Brigada XVI y ordenó al operativo retener y asesinar a los dos jornaleros para posteriormente vestirles de camuflado, una práctica conocida como “falsos positivos”. García Cespedes, condenado a 26 años de prisión tras aceptar su responsabilidad en el doble homicidio, entregó todos los detalles sobre este delito señalando directamente al comandante de la Brigada en la época de los hechos, el general Henry Torres Escalante. La investigación contra el general Escalante se encuentra actualmente en la Jurisdicción Especial para la Paz (JEP), jurisdicción a la que se sometió después que la Fiscalía General formulara acusación contra él.

§ El exmilitar José Perenguez Ortiz, condenado por la ejecución extrajudicial de dos jóvenes civiles en Suaza (Huila), se acogerá a la Jurisdicción Especial para la paz:

El exmilitar José Perenguez Ortiz, condenado por la ejecución extrajudicial de dos jóvenes civiles, Juan Perdomo Claros y Albert Augusto Lizcano Cedeño, quienes posteriormente fueron presentados como guerrilleros – práctica conocida en Colombia como “falsos positivos” – en Suaza (Huila), se acogerá a la Jurisdicción Especial para la paz. En concreto, Ortiz comparecerá en calidad de agente del Estado a fin de asistir en el esclarecimiento de dicha práctica de ejecuciones extrajudiciales.
