Weekly Update from The Special Jurisdiction of Peace

For The Guernica Group, the work developed by the Integral System of Truth, Justice, Reparation and No Repetition (SIVJRNR) of Colombia is essential to carry out and consolidate the Peace Accord. Victims are the central pillar and the guarantee for the need to define the truth and ensure accountability for key episodes of violence committed during the armed conflict, as the basis of long-lasting reconciliation. The Special Jurisdiction for Peace (JEP) has the potential to develop new legal precedents that could reshape the work of international criminal lawyers and generate a valuable legacy for the whole Latin American region.

Accordingly, The Guernica Group will provide weekly media updates from the Special Jurisdiction for Peace in order to expand the JEP’s outreach and generate debate around the cases, the judicial proceedings and the procedures of the different Chambers. The summary of the news will be published in both English and Spanish, and will include links to the relevant articles:

Habib Merheb returned to the country to respond for his involvement in parapolítica before the JEP:

Habib Merheg is a pereirano politician, on whom fall multiple accusations of parapolítica, illegal adjudication of lands, violation of rights of author and tax evasion. Merheg has been absent from Colombia since 2009, when the Supreme Court of Justice issued a warrant for his arrest and initiated an investigation for para-politics against Merheg. The investigations in this area related it to the Central Bolívar Bloc of the United Self-Defense Groups of Colombia. For this reason, the Highest Court decided to refer the Merheg file to the Special Jurisdiction for Peace.

The Attorney General's Office delivers two reports to the JEP:

On January 10, the Special Jurisdiction for Peace received two new reports from the Office of the Attorney General of the Nation, related to events and behaviour that took place in the context of the armed conflict. The reports are titled as: "Sources and financing mechanisms of the FARC-EP" and "Victimization of social leaders and defenders of Human Rights by Agents of the State.

With this delivery, the Office of the Prosecutor has already submitted 11 reports to the Chamber of Recognition of the Special Jurisdiction for Peace:

Former Senator Jorge Anibal Visbal Martelo presented his request for submission to the JEP:

Former President of Fedegan, former congressman, member of the Peace Commission with the Paramilitaries and former Ambassador of Colombia in Canada, Jorge Anibal Visbal, condemned by the supposed funding to the self-defenses under Carlos Castaño and Salvatore Mancuso, expressed his intention to reach out to the Special Justice for Peace. In a document addressed to the Juridical Situations Definition Room of the JEP, the former Ambassador Visbal explained in detail why his case should be studied in the Special Jurisdiction, whilst insisting on his innocence. In addition, the former Senator added to his request the ruling issued by a Court passing a sentence of 9 years and the confirmation of the Court of Bogotá that the sentence held him responsible for the crime of conspiracy to commit a crime.

Enilce López's lawyers and children present documents for the application for inclusion of the former businesswoman before the JEP:

Lawyers Alfredo Montenegro and Pablo Bustos publicly presented the documents for the application for inclusion of the chance entrepreneur Enilce López Romero and her children to the Special Jurisdiction for Peace. In the letter signed by Lopez and addressed to the Judges of the JEP, with fingerprints included, the former businesswoman said: "I manifest from now that the quality of direct or indirect actor in the Colombian armed conflict as a third party is within me, as a result of having participated in this ". In that sense, one of the family's lawyers said that Lopez's would be "an exceptional process because it is a family that submits, it is a business group, there are several generations, there are several departments with a direct exercise of power in the policy for more than two decades, and with the knowledge of Parapolítica and FARC-politics, it is the will of Enilce López to deliver the truth to the country.

Álvaro Uribe seeks a Legislative Act to reform the Special Jurisdiction for Peace:

According to Senator Álvaro Uribe of the Democratic Center, his Government Party will insist during 2019 on a Legislative Act with the objective of reforming the Special Jurisdiction for Peace (JEP). The idea of this initiative is to provide guarantees to members of the Public Force and speed up extradition procedures such as that involving Jesus Santrich. The former president argued that the ideal is a "really different treatment for the Armed Forces, not equal to terrorism," while on the extradition of ex-guerrilla Santrich is "simply on the certificate of the date and nature of the crime." In this regard, the Special Jurisdiction for Peace, in a statement from previous days, announced that the decisions in this specific case will be announced before January 28.

JEP will study the case of another former FARC officer requested in extradition by the United States for drug trafficking and obstruction of Justice:

The JEP agreed to study the request to stop the extradition of Luis Eduardo Carvajal alias "Rambo" - former commander of Daniel Aldana column of the FARC - required by the United States as an alleged link to the Sinaloa cartel. Sources of the JEP stated that this case is similar or of the same jurisdiction to that of Jesús Santrich to determine the date on which the crimes for which he is requested in extradition were committed.

JEP denies conditional freedom to inmate because it holds that his crimes are not related to the armed conflict:

The JEP - through the Amnesty Room of Pardon, denied the release of an inmate, Mario Ancizar Moreno Hueso, because it considers that the crimes for which he is being tried in Picaleña prison in Ibagué (co-conspirator of aggravated homicide, trafficking, carrying or possession of firearms, accessories, parts or ammunition and aggravated robbery) are not related to the armed conflict, despite the fact that it was certified in April 2018 by the Office of the High Commissioner for Peace, as a member of the FARC-EO disappeared.

Decisions of the JEP on Santrich will be known as of January 28:

On January 28 the deadline will be reached that was established by the Special Jurisdiction for Peace (JEP) for the United States Justice Department to pass on the evidence that it has on the alleged participation of Sexis Paucis Hernández Solarte, known as Jesús Santrich, in the shipment of cocaine to that country. The JEP had also requested from the Prosecutor General of the Nation the mirror copy of the audios of the interceptions with regards to Marlon Marín, nephew of Iván Márquez, in which the ex-guerrilla is incriminated. The Office of the Prosecutor delivered these audios to the JEP at the beginning of December. Once this deadline is met, the JEP will have eight working days to hear the allegations of the Attorney General and 'Jesus Santrich' and then decide whether or not to grant the benefit of non-extradition requested by the defense.

The Balance of the implementation of the Peace Agreement by the UN:

The most recent report of the secretary general of the United Nations (UN) to the Security Council on the work of the Organization's Verification Mission in Colombia highlights the achievements, in terms of reactivating by the authorities, the agreed instances for the implementation and follow-up of the agreement -as the Commission for Monitoring, Promotion and Verification of the Implementation of the Final Agreement (CSIVI) and the National Council for Reincorporation (CNR). Among the challenges that lie ahead, António Guterres points out that one of the challenges facing the parties in the process, is that of legal security for ex-combatants which is fundamental in generating trust and advancing social and political reintegration. Similarly, in order to ensure that mechanisms such as the Special Jurisdiction for Peace (JEP), the Commission for the Clarification of Truth, Coexistence and Non-Repetition or the Truth Commission, among others, exercise their work autonomously.

The five cases in which the JEP works:

In the first place, case 001 is called "Illegal retention of persons by the FARC between 1993 and 2012". This case involves 4,132 ex-guerrillas and 68 sentences have been issued, 8,163 victims have been identified in Antioquia, Meta and Bolíva.

Case 002 is a prioritization of the situation in Tumaco, Ricaurte and Barbacoas in the department of Nariño in events that occurred between 1990 and 2016. These are crimes such as homicides, massacres, false positives, recruitments, kidnappings, amongst others. Here, 1,259 victims are registered, 114 of the ex-combatants are liable, as well as 53 members of the security forces.

In case 003 there exists "false positives" in which young peasants were presented as guerrillas. There are 1,750 involved and 2,248 victims in which 45% are peasants from the departments of Cesar and Huila. The Departments of Antioquia, Casanare, Meta and Norte de Santander are the ones with the most investigations in these cases.

On the other hand, the JEP in its case 004 prioritizes the situation in Urabá where the FARC and the public force were between the years 1986 to 2016. There are 787,000 victims registered, 3,523 facts, 174 of those implied that they have evidence on at least 221 people.

Finally, case 005 is the prioritisation of Santander de Quilichao, Suarez, Buenos Aires, Morales, Caloto, Corinto, Toribio and Caldono in the north of the department of Cauca between the years 1993 to 2016. Here it is reported that there were more than 1,446 acts against the population, 1259 people as victims, 114 guerrillas and 53 members of the public force are involved.

The Constitutional Court will decide about 40 guardianships against the JEP:

The Constitutional Court will start in 2019 on Friday 11th January and will do so with the conviction of advancing all the processes that had to be postponed due to peace issues. Its president, Alejandro Linares, announced some of the issues that will have to be resolved, including the first protections against the JEP. "More or less, according to information from the General Secretariat there are about 40. We have not reached results in any, they are in the process of being reviewed by the different rooms and obviously there are many protections that have to do with people who have been excluded from the Special Jurisdiction for Peace, "he said.

Likewise, an issue that also has to do with the JEP, but with a difference as it is with the Office of the Prosecutor; is the conflict of competences that was generated between the two entities by the assets of the FARC. The Jurisdiction is trying to establish the list of all the goods and for this it required information from those that are in the process of extinction by the investigating entity. The Prosecutor's Office refused to provide it, and raised the conflict to the Court, so the matter is in the hands of magistrate Luis Guillermo Guerrero who already has a presentation on the matter.

Habib Merheb regresó al País para responder a la parapolítica ante la JEP:

Habib Merheg es un político pereirano, sobre el que recaen múltiples acusaciones de parapolítica, adjudicación ilegal de tierras, vulneración de Derechos de autor y evasión de impuestos. Merheg se ausentó de Colombia desde 2009, cuando la Corte Suprema de Justicia emitió orden de captura en su contra e inició una investigación por parapolítica contra Merheg. Las investigaciones por este rubro lo relacionaron con el Bloque Central Bolívar de las Autodefensas Unidas de Colombia. Por esta razón, el máximo Tribunal decidió remitir el expediente de Merheg a la Jurisdicción Especial para la Paz.

La Fiscalía General de la Nación entrega dos informes a la JEP:

El pasado 10 de Enero la Jurisdicción Especial para la Paz recibió dos nuevos informes por parte de la Fiscalía General de la Nación, relacionados con hechos y conductas ocurridas en el marco del conflicto armado. Los informes se titulan: "Fuentes y mecanismos de financiación de las FARC- EP" y "Victimización de líderes sociales y defensores de derechos humanos por parte de agentes del Estado".

El ex Senador Jorge Anibal Visbal Martelo presentó su solicitud de sometimiento a la JEP:

El ex presidente de Fedegan, ex Congresista, miembro de la Comisión de Paz con los paramilitares y ex embajador de Colombia en Canadá, Jorge Anibal Visbal, condenado por la supuesta financiación a las Autodefensas al mando de Carlos Castaño y Salvatore Mancuso, expresó su intención de llegar a la Justicia Especial Para la Paz. En un documento dirigido a la Sala de Definición de Situaciones Jurídicas de la JEP, el ex embajador Visbal, explicó con detalle por qué su caso debe ser estudiado en la Jurisdicción Especial, e insiste en su inocencia.
