For The Guernica Group, the work developed by the Integral System of Truth, Justice, Reparation and No Repetition (SIVJRNR) of Colombia is essential to carry out and consolidate the Peace Accord. Victims are the central pillar and the guarantee for the need to define the truth and ensure accountability for key episodes of violence committed during the armed conflict, as the basis of long-lasting reconciliation. The Special Jurisdiction for Peace (JEP) has the potential to develop new legal precedents that could reshape the work of international criminal lawyers and generate a valuable legacy for the whole Latin American region.

Accordingly, The Guernica Group will provide weekly media updates from the Special Jurisdiction for Peace in order to expand the JEP’s outreach and generate debate around the cases, the judicial proceedings and the procedures of the different Chambers. The summary of the news will be published in both English and Spanish, and will include links to the relevant articles:

The JEP will study the matter of "Jesus Santrich" without having received the probatory material requested from the United States in “Auto 059” of 2018

On October 23, 2018, through Auto 059, the JEP requested the collaboration of the Government of the United States to obtain the necessary probative material in order to define the situation of Seuxis Paucias Hernández Solarte "Jesús Santrich". In said Order, the Review Section established that once 40 days had passed following the request, it would continue with the procedure of “guarantee of non-extradition”, established in Transitory Article 19 of the Political Constitution of Colombia. On January 23, 2019, the Ministry of Justice confirmed that on December 10, 2018, it had sent the respective letter of request to the United States Department of State. On January 28, 2019, the deadline expired without the probative material being received. The Review Section thus proceeding to move the transfer for allegations, for a period of 5 working days, to the parties of this action (Attorney General's Office, the applicant and his counsel). On January 31, 2019, the Review Section received information from the Ministry of Justice regarding problems with the letter and immediately, the JEP Review Section began to study the matter and make a timely decision in accordance with the law.

The Army delivers to the Special Jurisdiction for Peace (JEP) documents that contextualise the situation in the regions where they operated:

The National Army through the Strategic Joint Transition Command, headed by General Néstor Rogelio Robinson Vallejo, and the Integral Legal Department led by General Javier Ayala Amaya has delivered to the Investigation and Accusation Unit of the JEP the document 'National Army: the armed conflict in the regions'. The document is the result of an interdisciplinary investigation carried out by 67 professionals amongst this group, sociologists, anthropologists, political scientists, historians, lawyers and archivists in several regions of the country, in which the challenges faced by the members of the Army are presented, within the dynamics of the conflict since 1948. The document is divided into three volumes that collect contextual information in the Western, Central Eastern and North Eastern regions, the latter develops an additional chapter on the context in the Catatumbo region.

The JEP has convened a Technical Board to verify conditions of preservation and access to the files of the Administrative Department of Security (DAS):

Last Wednesday, January 30, 2019, the Chamber of Recognition of Truth, Responsibility and Determination of the Facts and Conduct of the Special Jurisdiction for Peace (JEP) installed the Technical Board to verify the conditions of preservation and access to the 12,000 boxes of intelligence files, counterintelligence and reserved expenses of the now defunct Administrative Department of Security (DAS).

The installation of the Technical Board seeks to follow up on the precautionary measures that the JEP imposed on these files in March 2018, confirmed by means of Order 73 of October 26 of the same year, in which it was explained that currently one of the most important issues to be addressed is the lack of clarity about the type of document management that has developed around these files. The JEP highlights the importance of keeping the archives containing information about serious violations of Human Rights, in the context of the Colombian armed conflict, in view of the objectives pursued by the Integral System of Truth, Justice, Reparation and Non-Repetition (SIVJRNR). This Technical Board will meet periodically to draw up an action plan to identify the measures that must be implemented to preserve the intelligence and counterintelligence files of the defunct DAS in its entirety and to ensure that the implementation of security protocols for access and consultation is not imposing additional restrictions to those provided by law, particularly when dealing with information related to the violation of human rights or crimes against humanity.

The Supreme Court of Justice gives Musa Besaile Fayad a free hand to accord to the JEP:

The Special Chamber of the First Instance of the Supreme Court of Justice has just given free rein to the request of the ex-Senator Musa Besaile Fayad to the JEP, which studies and fails its file for parapolitics. When considering whether there is sufficient evidence to show that the trials for which he is being prosecuted are related to the Colombian armed conflict, the High Court decided to refer the case to the Legal Situations Room of the JEP, which in mid-March should define whether accept or not Besaile Fayad is within that jurisdiction.

President of the JEP: "Iván Márquez must go personally" to the summons of the JEP:

The president of the JEP, Patricia Linares, assured in a communication to the newspaper Caracol Radio that the law determines when the appearing ones can go through empowered or personally, or when you must submit reports. Patricia Linares has specified that Iván Márquez "is summoned to a version hearing to which he must attend personally if he does not do so, he will not comply with that requirement."

On the other hand, the rector of the Externado University and former president of the Constitutional Court, Juan Carlos Henao, said that Iván Márquez is not yet outside the Special Jurisdiction for Peace because he has not failed to comply with the personal citation that he made. However, he said that if Márquez does not personally attend the appointment that was placed, there would be a high risk of him falling outside the JEP. Henao said that if Márquez fails to comply with the appointment, the JEP may open an incident of contempt that could result in the person being excluded from the Transitional Justice Process and the case would be judged by the Ordinary Court, under the maximum penalties imposed by that Justice.

The Chamber of Amnesty or Pardon (SAI) of the JEP grants conditional release to Omaira Rojas Cabrera:

In resolving the request made on October 3, 2018, the Chamber of Amnesty or Pardon (SAI) of the JEP granted the benefit of conditional release to Omaira Rojas Cabrera, member of the FARC-EP's defunct guerrilla, who signed the Commitment Act with the JEP on September 28, 2018 in Bogotá.

The benefit of conditional freedom defines the legal status of the respondent. Therefore, it is a provisional and transitory measure, created by the rules that govern the JEP. Conditional release is granted to those who can prove that they were part of the FARC-EP, that the crimes were committed before December 1, 2016 and that they were related to the conflict. That analysis done by the JEP is of a preliminary nature, whilst awaiting a final decision to be made.

Therefore, it is not an amnesty or a pardon. This resolution also orders Rojas to immediately sign up to the Conditionality Regime Act. This regime makes the benefit of freedom conditional upon informing the SAI of any change of residence that it makes, abstaining from leaving the country without authorization, abstaining from committing any crime, participating in the programs of contribution to the reparation of victims of the conflict as cited, make themselves available to the Truth Clarification Commission and the Search Unit for Persons Disappeared and appear before the Special Jurisdiction for Peace each time it is called. The legal basis with which the SAI made the decision is Legislative Act 01 of 2017, the Final Peace Agreement and Law 1820 of 2016.

UNHCR Representative in Colombia Jozef Merkx and JEP President Patricia Linares signed a memorandum of understanding to make visible and influence the investigation of events that led to internal forced displacement.

Colonel Jorge Plazas Acevedo insists on going to the JEP for the murder of Jaime Garzón:

Colonel Jorge Eliécer Plazas Acevedo, a former member of military intelligence, is fully convinced that the trial against him for the murder of journalist and humorist Jaime Garzón, which is already in the stage of final arguments, must move to the Special Jurisdiction for Peace (JEP). He appealed the decision of the JEP to keep him in the ordinary courts. According to the defence of Colonel Édgar Torres, it is clear that the JEP has competence "over crimes committed for cause, occasion or in direct or indirect relation to the armed conflict", a requirement that, in his opinion, is entirely connected to the murder of Jaime Garzón.

The JEP finalises the practice of evidence for verifying compliance with Hernán Darío Velásquez Saldarriaga, alias "El Paisa":

The Chamber for the Recognition of Truth, Responsibility and Determination of the Facts and Conduct of the JEP, as of 12th January, confirmed the practice of evidence as ordered on on December 6 in the incident of verification of compliance with the conditionality regime of Hernán Darío Velásquez Saldarriaga, alias "El Paisa". Once the parties have been notified, this will run for 30 days to practice the following tests that were ratified by the Recognition Room.

The decision to confirm the practice of evidence, is given after the defence of Velasquez Saldarriaga filed an appeal against the order 090 of December 6, 2018, arguing that the Chamber of Recognition of the JEP requested intelligence information from the Ministry of Defense, which, in the opinion of the defense, is an illegal evidence and therefore violates due process. In response, the Recognition Room clarified that the intelligence information requested from the Ministry of Defense will be used as "guiding criteria" for the investigation, but it will not have probative value in itself, nor will it be used as evidence of the person's criminal responsibility. In that sense, the Recognition Room decided to order the Ministry of National Defense to gather, within a period of ten working days, intelligence information on the possible regrouping and resumption of weapons of the structures that operated under the command of Hernán Darío Velásquez Saldarriaga.

It must be remembered that the opening of the verification incident, was decided after September 10, 2018, the Recognition Room requested the 31 respondents in Case 001, including Velásquez Saldarriaga, individual reports and personal information about their reinstatement activities and other obligations relevant to the case. Of the 31 respondents, Velásquez was the only one who did not submit the report within the term granted or appeared before the summons for the initiation of Case 001 before the Examination Chamber (based on report N.2 from the Office of the Attorney General of the Nation) called "Illegal Withholdings by the FARC-EP)". Once all the tests are performed within 30 working days, which will remain available to the parties, the Recognition Room will have 10 business days to quote the hearing where it will verify whether or not there was a breach of the conditionality regime by Velásquez Saldarriaga. In this hearing, the type of sanction that may be imposed on the respondent will be established, in case the existence of the breach is proven.

JEP calls for 11 witnesses from the extinct FARC-EP, in the case of 002, on the situation of Ricaurte, Tumaco and Barbacoas (Nariño):

The Chamber of Recognition of Truth, Responsibility and Determination of Facts and Behaviors of the JEP ordered 11 witnesses of the former FARC-EP guerrillas to render a voluntary version within the framework of Case 002, which prioritizes the serious violations of Human Rights and International Law in the municipalities of Tumaco, Barbacoas and Ricaurte (in Nariño), from 1990 to 2016. In these territories there are 27 Community Councils and 42 indigenous reservations.

Through Auto 01 of January 14, 2019, the Recognition Room ordered 11 ex-members of the FARC-EP to appear in the first phase of voluntary versions that will begin from February 14, until March 8, 2019 in the cities of Cali, Pasto and Bogotá. This call for voluntary versions is given after the Chamber received 20 reports, 7 of them by social organizations, which were transferred to those previously mentioned. Article 27A of Law 1922 establishes that the voluntary version is practiced in the presence of the appearing party and its defender. This version has the purpose of gathering information to contribute to the search for the truth and listen to the version of the person appearing, regarding the events that have taken place. These versions will be recorded and, subsequently, transferred to the victims, so that they present their observations.

La Jurisdicción Especial para la Paz (JEP) tiene el potencial de desarrollar nuevos precedentes legales que puedan reconfigurar la justicia penal internacional y generar un legado fundamental en Latinoamérica.

La JEP estudiará el asunto de “Jesús Santrich” sin haber recibido el material probatorio solicitado en el Auto 059 de 2018 a Estados Unidos:

El 23 de Octubre de 2018, a través del Auto 059, la JEP le solicitó al Gobierno de los Estados Unidos colaboración para la obtención de material probatorio necesario para definir la situación de Seuxis Paucias Hernández Solarte “Jesús Santrich”. En dicho Auto la Sección de Revisión estableció que transcurridos 40 días, después de aquella solicitud, se procedería a continuar con el trámite de garantía de no extradición, establecido en el Artículo transitorio 19 de la Constitución Política de Colombia. El 23 de Enero de 2019, el Ministerio de Justicia confirmó que el 10 de Diciembre de 2018 había enviado al Departamento de Estado de Estados Unidos la respectiva carta rogatoria. El 28 de Enero de 2019 venció el plazo sin que se recibiese el material probatorio, procediendo la Sección de Revisión a correr traslado para alegatos, por el término de 5 días hábiles, a las partes de esta actuación (Procuraduría, el solicitante y su defensor). El 31 de Enero de 2019, la Sección de Revisión recibió información del Ministerio de Justicia, sobre problemas con el envío de la carta rogatoria. Inmediatamente, la Sección de Revisión de la JEP comenzó a estudiar el asunto y tomará una decisión oportuna conforme a la ley.

El Ejército entrega a la Jurisdicción Especial para la Paz (JEP) documentos que contextualizan la situación de las regiones donde operaron:

El Ejército Nacional por medio del Comando Conjunto Estratégico de Transición encabezado por El General Néstor Rogelio Robinson Vallejo y el Departamento Jurídico Integral dirigido por el General Javier Ayala Amaya ha entregado a la Unidad de Investigación y Acusación de la JEP, el documento ‘Ejército Nacional: el conflicto armado en las regiones’. El documento es el resultado de una investigación interdisciplinaria realizada por 67 profesionales entre sociólogos, antropólogos, politólogos, historiadores, abogados y archivistas en varias regiones del país, en el cual se plantean los desafíos a los que se tuvieron que enfrentar los integrantes del Ejército, dada la variación de las dinámicas del conflicto desde el año 1948. El documento está dividido en tres volúmenes que recopilan información de contexto en las regiones Centro Occidental Sur Oriental y Nororiental, este último, desarrolla un capítulo adicional sobre el contexto en la región del Catatumbo.

La JEP convocó una Mesa Técnica para verificar condiciones de preservación y acceso a los archivos del Departamento Administrativo de Seguridad (DAS):

El pasado Miércoles 30 de Enero 2019, la Sala de Reconocimiento de Verdad, de Responsabilidad y de Determinación de los Hechos y Conductas de la Jurisdicción Especial para la Paz (JEP) instaló la Mesa Técnica para verificar las condiciones de preservación y acceso a las al menos 12.000 cajas de archivos de inteligencia, contrainteligencia y gastos reservados del extinto Departamento Administrativo de Seguridad (DAS).

La instalación de la Mesa Técnica busca dar seguimiento a las medidas cautelares que la JEP impuso a estos archivos en Marzo de 2018, confirmadas por medio del Auto 73 del 26 de Octubre del mismo año, en el cual se explicó que actualmente uno de los riesgos más importantes se deriva de la falta de claridad sobre el tipo de gestión documental que se ha desarrollado en torno a estos archivos. La JEP destaca la importancia que tiene conservar los archivos con información sobre graves violaciones a los Derechos Humanos en el marco del conflicto armado colombiano, de cara a los objetivos que persigue el Sistema Integral de Verdad, Justicia, Reparación y No Repetición (SIVJRNR). Esta Mesa Técnica se reunirá periódicamente para elaborar un plan de acción que permita identificar las medidas que deberán implementarse para preservar en su integridad los archivos de inteligencia y contrainteligencia del extinto DAS y constatar que la implementación de protocolos de seguridad para el acceso y la consulta no imponga restricciones adicionales a las previstas legalmente, particularmente cuando se trate de información relacionada con la violación de los derechos humanos o delitos de lesa humanidad.

La Corte Suprema de Justicia le da vía libre al Exsenador Musa Besaile Fayad para acorderse a la JEP:

La Sala Especial de Primera Instancia de la Corte Suprema de Justicia acaba de darle vía libre a la petición del exsenador Musa Besaile Fayad para que sea la Jurisdicción Especial para la Paz (JEP) la que estudie y falle su expediente por parapolítica. Al considerar que existen evidencias suficientes de que los procesos por los cuales está siendo enjuiciado tienen relación con el conflicto armado colombiano, el alto tribunal decidió remitir el caso a la Sala de Situaciones Jurídicas de la JEP, que a mediados de marzo próximo deberá definir si acepta o no a Besaile Fayad en esa jurisdicción.
