The Guernica Group
For The Guernica Group, the work developed by the Integral System of Truth, Justice, Reparation and No Repetition (SIVJRNR) of Colombia is essential to carry out and consolidate the Peace Accord. Victims are the central pillar and the guarantee for the need to define the truth and ensure accountability for key episodes of violence committed during the armed conflict, as the basis of long-lasting reconciliation. The Special Jurisdiction for Peace (JEP) has the potential to develop new legal precedents that could reshape the work of international criminal lawyers and generate a valuable legacy for the whole Latin American region.
Accordingly, The Guernica Group will provide weekly media updates from the Special Jurisdiction for Peace in order to expand the JEP’s outreach and generate debate around the cases, the judicial proceedings and the procedures of the different Chambers. The summary of the news will be published in both English and Spanish, and will include links to the relevant articles.
§ The Special Jurisdiction for Peace and the Search Unit for Disappeared Persons (UBDP) develop technical table to determine precautionary measures on 16 places that could hold the bodies of missing people:
Thursday May 2nd, The First Instance Section for Cases of Absence of Acknowledgment of Truth and Responsibility for the Facts and Conduct of the JEP, set up a technical table with the Search Unit for Disappeared Persons (UBDP) to support the review process for precautionary measure requests, promoted by Movice, for the protection of 16 places located in Antioquia, Caldas, Cesar, Santander and Sucre. In these areas there may be bodies of possible victims. In the framework of these actions, defined as September 14 2018, through Auto 01, the JEP requested the support of the UBDP, in order to have its technical support, under the principle of harmonious collaboration and respect for its autonomy and for its extrajudicial and humanitarian character.

§ The Defence of Iván Márquez Marín, exleader of FARC-EP, presents a letter before the Special Jurisdiction for Peace noting that he will not personally attend the version proceeding scheduled for May 2, 2019 in the case 001, sending a written version in its place:
On April 26th, the Court of Recognition of Truth and Responsibility of the Special Jurisdiction for Peace received a letter presented by the defence of Iván Luciano Márquez Marín, ex-leader of FARC-EP. The defence, alleging "lack of security guarantees", indicated that Mr. Márquez Marín "will not personally attend" the proceeding of the version scheduled for this May 2, 2019, within case 001, entitled "Illegal retention of persons by the FARC-EP " on kidnapping. The plenary of the Chamber of Recognition of Truth and Responsibility of the JEP, meeting last April 30, assessed this letter and determined that, within 3 days, the defence will have to present their arguments and detailed evidence on these allegations, which will be evaluated by the Chamber as soon as possible to make a decision.
Subsequently, on May 2, the defence of Iván Luciano Márquez Marín submitted a document to the JEP, leaving a written version of it in case 001. In that document, Márquez Marín also recounts his security problems and acts of violence against him and his family. It also reiterates his commitment to the Peace Agreement. The Recognition Room will study the letter.

§ The debate on objections to the Statutory Law of the JEP proceeds to the Constitutional Court:
Over 50 days ago, the President Iván Duque announced his objections to seven articles of the Statutory Law of the Special Jurisdiction for Peace (JEP). This past Tuesday, April 20th, in a plenary session in the Senate, the “Peace” Block managed to gather the 47 votes needed to deny the presidential objections to the Statutory Law. Now, without making a decision, the Senate will send the discussion to the Constitutional Court in order to determine if the vote last Tuesday and the 47 votes rejecting, are sufficient to reject the presidential objections to the Statutory Law.

§ The Special Jurisdiction for Peace accepts the submission from ex-congressman and political leader David Char Navas, the first agent of the State not related to the Public Force, that is accepted into the JEP:
On April 30th, the Court of Definitions of Judicial Situations – through resolution 1641 – accepted the submission request of former congressman David Char Navas. With this decision, the ex-Congressman and political leader of the Atlantic is the first State agent, other than the public force, that has been accepted by the JEP.
Char Navas is currently being tried by the Supreme Court of Justice for aggravated conspiracy to commit crimes - due to his presumed relationship with paramilitary groups - and for the manufacture, trafficking and carrying of firearms and ammunition for the exclusive use of the Armed Forces. He is currently in preventive detention. Char Navas has pledged to identify other members of the Congress of the Republic, of whom ordinary justice has no news, who supported the political and armed paramilitary project between 2002 and 2010. Additionally, the ex-congressman has also committed to contribute to the truth about the concrete participation that he, as well as other agents of the State and businessmen, had in the financing and expansion of the project of the United Self-Defense Forces of Colombia (AUC).

§ The Special Jurisdiction for Peace releases a list of people to be investigated for para-politics:
April 30th, the Court of Definitions of Judicial Situations of the JEP, made public a list of State agents, separate from the public forces, that have been asked to submit to the jurisdiction. The requests for these appearances are being studied by the Court of Definition, which will define if its submission is accepted before the JEP and if they will have access to benefits like the Comprehensive System of Truth, Justice, Repair and Non- Repetition. As provided by the Constitutional Court, State agents and civilians can only submit to the JEP voluntarily. In turn, the Appeals Section of the JEP established that the State agents, in requesting their submission, must sign the minutes and must also present before the Definition Room a concrete and clear program of contribution to the truth, reparation and non-repetition. Once the Chamber studies said program, it will define whether or not it accepts the submission of the State or civil agent.

§ Guillermo Torres Cueter, Abelardo Caicedo Colorado and Juan Hermilo Cabrera, old leaders of FARC-EP, present their voluntary version of events before the Special Jurisdiction for Peace:
On the 29th and 30th of April, Guillermo Torres Cueter, Abelardo Caiceda Colorado, and Juan Hermilo Cabrera Díaz, old leaders of FARC-EP, presented their voluntary version of events before the Court of Recognition of the JEP in the Palace of Justice in Valledupar. These presentations formed part of Case 001; “Illegal retention of people on the part of Farc-EP”. 16 ex-leaders of FARC have already presented their voluntary version of events before the JEP.
To date, 188 victims have been accredited and have asked to be special interveners in the case 001 in order to exercise their right to receive protective measures, to know the truth of what happened, to do justice and restore the damage caused by the crimes. Among the accredited victims, there are people who were allegedly kidnapped for the purpose of exchange, extortion and other forms of kidnapping.

§ Luis Moreno-Ocampo, ex-prosecutor of the International Criminal Court (ICC), clarified that the focus of the Special Jurisdiction for Peace on those most responsible prevents the ICC from intervening in Colombia:
Ex-prosecutor of the International Criminal Court, Luis Moreno-Ocamp, has spoken out against the objections presented this past month by President Iván Duque to the Statutory Law of the Special Jurisdiction for Peace (JEP). According to President Duque, if his refusal is not accepted that the JEP focuses on prosecuting those most responsible (Article 19 of the aforementioned law), impunity could be generated and the ICC could intervene in the Colombian case to investigate, prosecute and sanction serious war crimes or crimes against humanity.
However, according to Moreno-Ocampo, Colombia would not be in the sights of the ICC because only the top commanders of the extinct FARC guerrilla are judged in the JEP. Regarding this objection, contrary to what the government of Iván Duque maintains, ex-Prosecutor Moreno-Ocampo is clear: "The Rome Statute defines that the existence of genuine national procedures prevents the intervention of the ICC", it being "the policy of the ICC to judge the maximum responsible ".

§ The Special Jurisdiction for Peace orders the capture of Hernán Darío Velázquez Saldarriaga – known as “El Paisa” - for violating the conditionality regime severely, with May 15 as the deadline to resolve the appeals filed:
On Friday April 26th, the Court of Recognition of Truth, Responsibility, and Determination of the Facts and Conduct of the Special Jurisdiction for Peace (JEP) ordered the National Police and Interpol to capture Hernán Darío Velásquez Saldarriaga and make him available to the JEP. The decision was taken at the public hearing on April 26, where the Chamber concluded that Velásquez Saldarriaga had seriously breached the conditions to access and maintain the benefits granted under the Peace Agreement, since he has failed to appear before the courts. He has also failed to contribute to providing the truth and to the reparation of victims. As a result, the Chamber revoked the benefit of conditional freedom that Velasquez Saldarriaga had received under Decree-Law 900 of 2017 and the benefit of the conditional release of ordinary justice based on Law 1820 of 2016.
The reactions to the arrest warrant issued by the Special Jurisdiction for Peace (JEP) against Hernán Darío Velásquez Saldarriaga, known in the war as 'El Paisa', were immediate. While some celebrated the decision and felt assured that the JEP is not a court of impunity, others worried about the absence of the former guerrilla leader, who is responsible, according to ordinary justice, for more than 128 incidents. By way of illustration, Bertha Lucía Fries, victim of the attack against El Nogal, says that, despite the fact that the decision of the JEP, as a victim, is absolutely correct, she feels that it is a loss not to be able to count on the truths that Velásquez Saldarriaga could provide. As one of the top leaders of the FARC, a part of the conflict may remain hidden.
Finally, on May 2, the JEP reconvened those interested in attending after the hearing to verify compliance with the conditionality regime of Hernán Darío Velásquez Saldarriaga. The hearing took place at the JEP facilities on May 3, 2019, at 8:00 a.m. In this hearing, the Attorney General's Office and the appellant's defence had the opportunity to present the corresponding appeals against the decision issued by the Chamber on April 26, 2019. Mónica Cifuentes, delegate of the Public Prosecutor's Office filed an appeal of replacement with the aim of clarifying the decision made by the JEP against Hernán Darío Velásquez. For its part, the defence requested an appeal with support in writing. Finally, the Recognition Chamber of the JEP, through the order of May 3, 2019, decided to suspend the hearing of the allegations and decision of the verification incident of the conditionality regime of Hernán Darío Velásquez, until a decision on the appeals that had been filed was reached.

On April 25th, Miroslav Jenča met with representatives of the Comprehensive System of Truth, Justice, Reparation, and Non-Repetition, including the JEP. In the meeting, the Secretary of the UN highlighted the work of the JEP and its commitment to the victims.

§ During 2018, the Automatic System of Advisory and Defence of the Special Jurisdiction for Peace (JEP) conducted 1,069 advisory services and appointed 508 lawyers:
The JEP has the Autonomous System of Counselling and Defence (SAAD), a free service for ex-combatants of FARC-EP, members of the Public Force and third parties prosecuted for crimes related to the armed conflict. During 2018, the Autonomous Advisory and Defence System of the JEP conducted 1,069 advisory services and appointed 508 lawyers. In 2019, this system has designated attorneys for 180 persons appearing and has provided 29 judicial advisory services.

Gustabo Bocanegra, alias “Donald”, former chief of finance of the XXI front of the FARC that operated in the department of Tolima, will share his version of events before the Special Jurisdiction for Peace on May 8th. § La Jurisdicción Especial para la Paz y la Unidad de Búsqueda de Personas dadas por Desaparecidas (UBDP) instalan mesa técnica para definir medidas cautelares sobre 16 lugares que podrían tener cuerpos de personas desaparecidas:
El pasado jueves 2 de mayo, la Sección de Primera Instancia para Casos de Ausencia de Reconocimiento de Verdad y Responsabilidad de los Hechos y Conductas de la JEP instaló, una mesa técnica con la Unidad de Búsqueda de Personas dadas por Desaparecidas (UBDP) para apoyar el proceso de estudio de la solicitud de medidas cautelares, promovidas por el Movice, para la protección de 16 lugares ubicados en Antioquia, Caldas, Cesar, Santander y Sucre. En estas áreas habría cuerpos de posibles víctimas de desaparición. En el marco de estas actuaciones, definidas desde el 14 de septiembre de 2018, a través del Auto 01, la JEP solicitó el acompañamiento de la UBDP, con el fin de contar con su concepto técnico, bajo el principio de colaboración armónica y de respeto por su autonomía y por su carácter extrajudicial y humanitario.

§ La defensa de Iván Márquez Marín, exjefe de las FARC-EP, presenta un escrito ante la Jurisdicción Especial para la Paz señalando que no asistirá personalmente a la diligencia de versión prevista para el 2 de mayo 2019 en el marco del caso 001, remitiendo versión escrita en su lugar:
El pasado 26 de abril, la Sala de Reconocimiento de Verdad y Responsabilidad de la Jurisdicción Especial para la Paz recibió un escrito presentado por la defensa de Iván Luciano Márquez Marín, exjefe de las FARC-EP. La defensa, alegando “falta de garantías en materia de seguridad”, señaló que el señor Márquez Marín "no asistirá personalmente" a la diligencia de versión prevista para este 2 de mayo de 2019, dentro del caso 001, denominado "Retención ilegal de personas por parte de las FARC-EP", conocido como el de secuestro. El pleno de la Sala de Reconocimiento de Verdad y Responsabilidad de la JEP, reunido el pasado 30 de abril, valoró este escrito y determinó que, en el plazo de 3 días, la defensa tendrá que presentar la argumentación y evidencia probatoria detallada sobre dichas alegaciones, las cuales serán valoradas por la Sala a la mayor brevedad para tomar una decisión al respecto.
Posteriormente, el pasado 2 de mayo, la defensa de Iván Luciano Márquez Marín remitió un documento a la JEP dejando por escrito su versión dentro del caso 001. En dicho documento, Márquez Marín también relata sus problemas de seguridad y hechos de violencia en contra de su grupo familiar. Asimismo, reitera su compromiso con el Acuerdo de Paz. La Sala de Reconocimiento estudiará dicho escrito.
