For The Guernica Group, the work developed by the Integral System of Truth, Justice, Reparation and No Repetition (SIVJRNR) of Colombia is essential to carry out and consolidate the Peace Accord. Victims are the central pillar and the guarantee for the need to define the truth and ensure accountability for key episodes of violence committed during the armed conflict, as the basis of long-lasting reconciliation. The Special Jurisdiction for Peace (JEP) has the potential to develop new legal precedents that could reshape the work of international criminal lawyers and generate a valuable legacy for the whole Latin American region.

Accordingly, The Guernica Group will provide weekly media updates from the Special Jurisdiction for Peace in order to expand the JEP’s outreach and generate debate around the cases, the judicial proceedings and the procedures of the different Chambers. The summary of the news will be published in both English and Spanish and will include links to the relevant articles.

§ The Inter-American Commission on Human Rights urges Colombia to continue investigating the alleged cases of extrajudicial executions in the Dabeiba cemetery:

In December 2019, the Special Jurisdiction for Peace (Jurisdicción Especial para la Paz, JEP) began to carry out exhumations in a mass grave located in “Las Mercedes” cemetery in Dabeiba (Antioquia). It is presumed that in this grave lie buried approximately 50 victims of extrajudicial executions by State agents. One month since these exhumations, the Inter-American Commission on Human Rights (IACHR) has urged Colombia to prioritize the investigation of these events, in which the Eleventh Brigade and the Counter-guerrilla Battalion No. 79 of the Army were allegedly involved. Specifically, the president of the IACHR, Mrs. Esmeralda Arosemena de Troitiño, has stated that, in cases of extrajudicial executions or enforced disappearances, "the State has the obligation to conduct an investigation without delay, in a serious, impartial and effective manner." Significantly, the IACHR has emphasized that the adequate collection and preservation of the human remains are indispensable conditions towards the determination of what happened to the victims, as well as for the investigation, prosecution and punishment of those responsible.

On the other hand, the JEP has carried out several judicial inspections and is currently executing a joint work plan in conjunction with other entities to identify the human remains found. Additionally, inspections and exhumations have begun in five other cemeteries, within the investigation of Case No. 003, called "Deaths illegitimately presented as casualties in combat by State agents."

§ The United Nations Verification Mission in Colombia analyzes the implementation of the Peace Agreement:

In a 19-page report, the United Nations Verification Mission in Colombia has analyzed the implementation of the Peace Agreement in the country, celebrating the work that the JEP has carried out since its entry into force. The document, which analyses the progress achieved in each macro case before the JEP, highlighted that “the Special Jurisdiction for Peace has accredited more than 60,000 victims to date and has carried out the first collective accreditation's of ethnic communities. In addition, it continues to examine on a case-by-case basis the 657 applications submitted by State agents and third parties to the conflict, who voluntary decided to apply to it”.

§ General Diego Villegas, investigated for his alleged participation in extrajudicial executions, will lead the transformation of the Army:

With the arrival of the new commander of the National Army of Colombia, General Eduardo Zapateiro, there have been promotions within the institution that have been severely criticized by civil society. Among the people who changed job post, is Brigadier General Diego Villegas Muñoz, former commander of the Vulcan Task Force (Fuerza de Tarea Vulcano) - a special unit that operates in Catatumbo -, who is currently under investigation for his participation in extrajudicial executions of civilians during the armed conflict. Villegas Muñoz, who requested to be accepted before the JEP last February, has become the head of the Comando de Transformación Ejército del Futuro (COTEF), an institution in charge of leading the process of building new Military Forces in Colombia.

§ The Presidency of the Republic finalizes the draft decree on the handing over of the inventory assets of the FARC-EP, which will be destined to repair victims of the armed conflict:

According to the media outlet “RCN Radio”, the Presidency of the Republic would have already finalized drafting the proposed decree that sets the deadline for ex-combatants of the FARC-EP, who adhered to the Peace Agreement, for handing over of the assets of the group, which will be used to repair the victims of the armed conflict in the country. According to this proposal, the deadline for handing over these assets would be July 31, 2020. Once this period is expired, “the entity designated to receive, verify, custody and administer the inventoried goods will report the result of the voluntary delivery to the Special Jurisdiction for Peace (JEP) and the Attorney General's Office (FGN)”.

§ John Jairo Giraldo Velásquez, a former FARC-EP combatant known as “Edier”, could be expelled from transitional justice system:

After an operation carried out by the National Police and the Attorney General’s Office, John Jairo Giraldo Velásquez, former FARC-EP combatant known as alias of "Edier" and five other people have been captured. According to the investigations, these individuals could have participated in the murder of ex-combatant Alexander Parra Uribe, which occurred on October 24 and was the leader of the Territorial Training and Reincorporation Space Mariana Páez (Espacio Territorial de Capacitación y Reincorporación, ETCR) of Mesetas (Meta). If proven that Giraldo participated in the aforementioned murder, he would consequently be expelled from the transitional system, losing the criminal benefits granted by the Special Jurisdiction for Peace.

ACTUALIZACIÓN SEMANAL - JURISDICCIÓN ESPECIAL PARA LA PAZ (JEP)

§ La Comisión Interamericana de Derechos Humanos insta a Colombia a continuar investigando los supuestos casos de ejecuciones extrajudiciales en el cementerio de Dabeiba:

Un mes después de que la Jurisdicción Especial para la Paz (JEP) comenzase a realizar exhumaciones en una fosa común ubicada en el cementerio “Las Mercedes” en Dabeiba (Antioquia), donde se presume que se encuentran 50 cuerpos de civiles víctimas de ejecuciones extrajudiciales por agentes del Estado, la Comisión Interamericana de Derechos Humanos (CIDH) ha instado a Colombia a priorizar la investigación sobre estos hechos, en los que habrían estado presuntamente involucradas la Décimo Primera Brigada y el Batallón de Contraguerrilla No. 79 del Ejército. En concreto, la presidenta de la CIDH, Doña Esmeralda Arosemena de Troitiño, ha declarado que, en casos de ejecuciones extrajudiciales o desapariciones forzadas, "el Estado tiene la obligación de realizar una investigación sin dilación, seria, imparcial y efectiva”. Significativamente, la CIDH ha enfatizado que la recolección y preservación correcta de restos humanos son condiciones indispensables para la determinación de lo sucedido a las víctimas y para la investigación, proceso y sanción de los responsables.

Por su parte, la JEP ha realizado varias inspecciones judiciales y está ejecutando un plan de trabajo conjunto con otras entidades para la identificación de los cuerpos hallados. Adicionalmente, se han comenzado inspecciones y exhumaciones en otros cinco cementerios dentro de la investigación del Caso No. 003, denominado “Muertes ilegítimamente presentadas como bajas en combate por agentes del Estado”.

§ La Misión de Verificación de las Naciones Unidas en Colombia analiza la implementación de la paz:

En un informe de 19 páginas, la Misión de Verificación de las Naciones Unidas en Colombia ha analizado la implementación de la paz en el país, celebrando el trabajo que la JEP ha llevado a cabo desde su entrada en vigor. El documento, que expone los avances alcanzados en cada macro caso de la JEP, ha destacado que “la Jurisdicción Especial para la Paz ha acreditado a más de 60.000 víctimas hasta la fecha y ha llevado a cabo las primeras acreditaciones colectivas de comunidades étnicas. Además, sigue examinando caso por caso las 657 solicitudes presentadas por agentes del Estado y terceras partes del conflicto para someterse voluntariamente a ella”.

§ El general Diego Villegas, investigado por su presunta participación en ejecuciones extrajudiciales, liderará la transformación del Ejército:

Con la llegada del nuevo comandante del Ejército Nacional de Colombia, el general Eduardo Zapateiro, ha habido varios cambios de puesto dentro de la institución que han sido criticados por la sociedad civil. Entre las personas que cambiaron de cargo, se encuentra el brigadier general Diego Villegas Muñoz, excomandante de la Fuerza de Tarea Vulcano —unidad especial que opera en Catatumbo-, quien está actualmente siendo investigado por su participación en ejecuciones extrajudiciales de civiles durante el conflicto armado. Villegas Muñoz, quién solicitó ser aceptado en la JEP el pasado febrero, ha pasado a estar al frente del Comando de Transformación Ejército del Futuro (COTEF), institución encargada de liderar el proceso de construir unas nuevas Fuerzas Militares en Colombia.

En una entrevista con el medio informativo “El Espectador”, la presidenta de la Jurisdicción Especial para la Paz ha reflexionado sobre el trabajo realizado por la justicia transicional durante el año 2019, relatando cómo ha vivido momentos tales como la aprobación de la Ley Estatutaria, las objeciones presentadas por el presidente Iván Duque y las críticas sobre el caso de Seuxis Pausias Hernández Solarte (“Jesús Santrich”). § La Presidencia de la República finaliza el proyecto de decreto sobre la entrega de los bienes inventariados de las FARC-EP, que serían destinados a reparar víctimas del conflicto armado:

Según el medio informativo “RCN Radio”, la Presidencia de la República habría finalizado el proyecto de decreto que fija el plazo límite a los excombatientes de las FARC-EP que se acogieron al Acuerdo de Paz para proceder a entregar los bienes inventariados del grupo, que se utilizarán para reparar a las víctimas del conflicto armado en el país. Según este proyecto de decreto, la fecha límite de entrega sería el 31 de julio del año 2020. Vencido dicho plazo, “la entidad designada para realizar la recepción, verificación, custodia y administración de los bienes inventariados informará el resultado de la entrega voluntaria a la Jurisdicción Especial para la Paz (JEP) y la Fiscalía General de la Nación (FGN)”.

§ John Jairo Giraldo Velásquez, excombatiente de las FARC-EP conocido con el alias de “Edier”, podría ser expulsado de la justicia transicional:

Tras un operativo de la Policía Nacional y de la Fiscalía General de la Nación, John Jairo Giraldo Velásquez, excombatiente de las FARC-EP conocido como alias de “Edier” y otras cinco personas han sido capturadas. Según las investigaciones, estos individuos podrían haber participado en el asesinato del excombatiente Alexander Parra Uribe, ocurrido el pasado 24 de octubre y quien era líder del Espacio Territorial de Capacitación y Reincorporación Mariana Páez (ETCR) de Mesetas, Meta. De comprobarse que Giraldo participó en el referido asesinato, éste sería expulsado del sistema transicional, perdiendo los beneficios de la Jurisdicción Especial para la Paz.
