Working Group on Arbitrary Detention, 2011, Communication 66/2011 concerning Motiur Rahman Nizami, Abdul Quader Molla, Mohammad Kamaruzzaman, Ali Hasan Mohammed Mujahid, Allama Delewar Hossain Sayedee and Salhuddin Quader Chowdhury

The Working Group on Arbitrary Detention decided that the deprivation of liberty of these citizens -later convicted by the International Crimes Tribunal of Bangladesh- was arbitrary and constituted a breach of article 9 of the Universal Declaration of Human Rights and article 9 of the International Covenant on Civil and Political Rights, falling into category III of the categories applicable to the cases submitted to the Working Group. After more than one year in pretrial detention pursuant to the order of the International Crimes Tribunal, the defendants had not yet been formally informed of the charges.
